Terms of Service
Last updated: 31 August 2026
These terms govern the use of Nitah, the learning and assessment service at asknitah.com, provided by Nitah (“we”, “us”). By using Nitah — as a school, a teacher, or a student joining with a class code — you agree to them. Our Privacy Policy explains how we handle personal data and forms part of these terms.
1. What Nitah is
Nitah gives students examiner-style marking of typed working, a personal mastery map, scheduled re-tests of their own mistakes, and a bounded study helper; it gives teachers assignments, class heatmaps and a weekly class report built from their students’ real work. Nitah is aligned to Cambridge IGCSE syllabuses.
Nitah is an independent product. Cambridge IGCSE is a trademark of Cambridge University Press & Assessment (UCLES). Nitah is not affiliated with, endorsed by, or approved by Cambridge University Press & Assessment, and no Nitah mark or prediction is an official Cambridge result.
2. Accounts
- Nitah is a closed system. School and teacher accounts are created by us or by a school administrator; student accounts exist only through a class code issued by a teacher.
- Keep your password to yourself. Class codes are for the students of that class — don’t publish them. Teachers can rotate a leaked code at any time.
- You are responsible for activity on your account. If you believe your account has been compromised, tell your teacher (students) or us (schools) promptly.
- Schools confirm that they are authorised to enrol their students — including any parental consent the school’s own policies or applicable law require — and that roster information they provide is accurate.
3. Acceptable use
Use Nitah for learning and teaching. In particular, do not:
- attempt to access another person’s account or another school’s data;
- probe, overload or interfere with the service, or bypass its security or rate limits;
- use the study helper to harass, or to attempt to extract answers to assessed work by deception (teachers can see hint usage and review conversations);
- upload unlawful content, or content you have no right to share;
- copy, scrape or resell Nitah’s question bank or feedback.
4. Marking, AI and human oversight
- Marking is automated, examiner-style, and deterministic. It is designed to be right, and to refuse to guess: working the engine cannot read goes to the teacher to decide.
- Students can flag any marking; teachers can overrule any mark, and a confirmed fault withdraws the affected question template until it is re-reviewed.
- Study-helper replies may be generated with AI (see the Privacy Policy). They are study support, not professional advice, and Nitah will not assert a numerical answer it cannot verify.
- Nitah’s marks, mastery states and reports are teaching signals. They are not official grades, predictions of exam results, or a substitute for a teacher’s judgement.
5. Content and intellectual property
- Nitah — including its software, question templates, mark schemes and feedback — belongs to us or our licensors. Schools and their users get a non-exclusive, non-transferable right to use it for the school’s educational purposes while their agreement is active.
- Students’ work stays theirs. Students (and their schools) grant us the licence needed to store, mark, display and process that work in order to provide the service — nothing more.
- Worksheets a teacher uploads remain the school’s. They stay private to that school and are distributed to its students for viewing only; Nitah does not mark uploads.
6. Availability
We work to keep Nitah fast and available, including on low-bandwidth connections — practice even queues offline and syncs when a connection returns. Nitah is provided “as is”; we do not promise uninterrupted availability, and we may update, change or withdraw features. Where the service is provided under a pilot or written agreement with a school, that agreement’s service terms prevail over this section.
7. Suspension and termination
- Schools may stop using Nitah at any time. Before or upon leaving, the school administrator can export all of the school’s data and permanently delete it (see the Privacy Policy).
- Teachers may remove a student from a class at any time; removal ends the student’s access through that class.
- We may suspend or restrict access that breaks these terms, threatens other users’ data, or endangers the service — telling the school unless the law prevents it.
8. Liability
Nothing in these terms excludes liability that cannot be excluded by law. Otherwise, to the fullest extent permitted by law: we are not liable for indirect or consequential loss, loss of data caused by factors outside our control, or academic outcomes; and our total liability arising out of the service in any 12-month period is limited to the amounts paid to us for the service in that period (or, where the service was provided free of charge, to BWP 1,000).
9. Changes to these terms
We may update these terms as Nitah evolves. If a change is material we will tell schools directly before it takes effect; continuing to use Nitah after that is acceptance of the updated terms. The current version always lives at this address.
10. Governing law
These terms are governed by the laws of the Republic of Botswana, and the courts of Botswana have jurisdiction over disputes arising from them — unless a written agreement between us and a school says otherwise.
